Personal Data Protection Policy

1. General Information

1.1 This Policy regulates Indochina Link Vietnam’s processing of Client’s personal data.

1.2 It also governs the processing of personal data of:

• Other third parties and relevant persons of the Client, as required by law or case.
• Third-party personal data provided to Indochina Link Vietnam under the Agreement, where the Client represents and warrants that the data was legally collected and consent was obtained from the data subject before sharing it with Indochina Link Vietnam.

1.3 Personal data processing includes activities such as collecting, recording, analyzing, confirming, storing, correcting, disclosing, combining, accessing, retrieving, encrypting, decrypting, copying, sharing, transmitting, providing, transferring, deleting, and destroying personal data or other related activities.

1.4 Indochina Link Vietnam acts as the controller and/or processor of personal data within the scope of this Policy.

2. Types of Processed Personal Data

Personal data can include basic and sensitive personal data, which refers to information about individuals in forms such as symbols, letters, numbers, images, sounds, or other digital formats that identify or can identify a particular person.

Indochina Link Vietnam has the right but is not obligated to collect Client’s personal data through methods such as taking notes, entering data electronically, recording instructions or verbal information, recording video, notarization, bailiff’s reports, and other methods deemed appropriate and compliant with the law.

3. Purpose of Processing Personal Data

Indochina Link Vietnam collects and processes personal data as a controller and processor for purposes related to agreements, contracts, statistics, management, reporting, conflict checking, risk management, internal control, accounting, auditing, financial purposes, surveys, research, quality evaluations, dispute resolution, storage, and database administration.

4. Method of Processing Personal Data

a. Manual processing of personal data.

b. Automatic processing of personal data.

5. Duration of Data Processing

Processing begins when Client provides personal data to Indochina Link Vietnam or when it is collected under the Agreement. Processing continues for the duration of the Agreement’s validity. Data processing ends when Indochina Link Vietnam no longer stores the personal data per Company and legal regulations. Indochina Link Vietnam may store personal data for a legally prescribed period.

6. Client Rights and Obligations

Clients have the right to:

• Know, consent, access, withdraw consent, request data deletion, limit data processing, provide data, object to data processing, complain, denounce, sue, request compensation for damages, and self-protect under personal data protection laws.

Indochina Link Vietnam may request additional documents to verify and identify clients when accessing and editing personal data.

Clients are obligated to:

• Protect their personal data, ensure others protect their data, provide complete and accurate data when allowing Indochina Link Vietnam to process it, comply with legal regulations on personal data protection, and fulfill other legal obligations.

7. Miscellaneous Provisions

This Personal Data Processing Policy is an inseparable part of the Service Contracts between Indochina Link Vietnam and Clients. Indochina Link Vietnam processes Client’s data based on consent per this Policy, unless otherwise provided by law.

Withdrawal of consent will not affect prior data processing based on previously given consent.
